Social networking sites such as Facebook, Twitter, Friendster, MySpace, Windows Live Spaces etc etc have allowed people to easily let other know what is on their mind. But users like us should be very careful on what we post because there's laws enforced on cyberspace! EWWW!!!
Some people think that they can write and post anything, but that is not true. Internet posts are subject to similar laws as that of print media, aside from the Communications and Multimedia Act 1998(MCMC Act). You have to be careful on what you write, and not just post what comes off the top of your head.
More recently, DAP member Teng Chang Khim was summoned to appear before the party disciplinary committee for a Twitter message that read:" OMG! Real culprit freed!"
Don't think that WWW header means Wild Wild West okay? Don't post anything that causes calamities such as 513! Remember Raja Petra? Yeah, MSIA is busting him right now...
Okay, lets see on the laws that applicable on social networking....weee~
Sedition Act 1948
- Posting something that has a seditious tendency - for instance, inciting hatred against the Government or the administration of justice; or inciting racial unrest.
Internal Security Act 1960(msia only! this is fkin' famous!)
-Where a person is detained to prevent him from acting in any matter prejudicial to the security of Malaysia - as used against blogger RPK!
Defamation
In general, defamation occurs when a statement soils the reputation of another person. There are two types - civil defamation under the Defamation Act 1957; and criminal defamation under Section 499 of the Penal Code. (Well, I guess you guys better start taking safety measure not to defame other people...)
Copyright infringement
This is where the work of another is reproduced in any form without the consent of the owner. It can apply to music, film, photographs etc etc
Communications and Multimedia Act 1998
Sect 211 of the Act prohibits the provision of offensive content, while S233 provides for improper use of network facilities, which basically covers all manner of online activity.
Penal Code
Various sections apply, covering distribution of obscene materials, cheating and criminal intimidation.
